1) Agreement to Terms

By accessing shopjamiko.com (the “Site”) and/or purchasing from us (the “Services”), you agree to these Terms and our Privacy Policy and Return & Refund Policy. If you do not agree, do not use the Services.

2) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase. By using the Services, you represent you meet this requirement and are legally able to enter a contract.

3) Account & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.

4) Products, Content & Availability

Product images, titles, descriptions, and specs are provided in good faith and may contain minor errors or variations (e.g., manufacturer packaging updates). We may limit quantities, discontinue products, or refuse service at our discretion.

5) Pricing, Taxes & Promotions

Prices are shown in USD unless stated otherwise and may change without notice. You are responsible for applicable taxes, duties, and fees. Discount codes and promotions are subject to individual terms and may be modified or withdrawn at any time.

6) Orders & Payment

All orders are offers to buy and are subject to acceptance by us. We may cancel or refuse any order (e.g., suspected fraud, inventory errors, pricing mistakes, compliance issues). We accept the payment methods listed at checkout; by submitting payment, you authorize us and our payment processor to charge your method for the order total, taxes, shipping, and any additional agreed amounts (e.g., reshipment fees).

Chargebacks & Payment Disputes

If you dispute a legitimate charge without contacting us first, we may suspend or terminate your account and pursue collection. Please reach out to support@shopjamiko.com—we’re happy to help.

7) Shipping, Delivery & Risk of Loss

Shipping options, costs, and estimated delivery times are shown at checkout. Title and risk of loss pass to you upon delivery to the carrier. We are not liable for delays or events outside our control (carrier delays, customs, weather, etc.). For lost/ stolen packages marked Delivered, file a claim with the carrier; we’ll assist where possible.

8) Returns, Refunds & Non-Returnable Items

Returns are governed by our Return & Refund Policy.
All Trading Card Game (TCG) items—including Pokémon booster packs/boxes, ETBs, tins, bundles, singles, graded cards, and any randomized/collectible card products—are FINAL SALE and non-returnable. Factory seal variations and minor cosmetic packaging dings that do not affect contents are not defects.

9) Preorders & Allocation

Release dates are estimates and may change. If manufacturer/distributor allocation is reduced, we may partially fulfill or cancel and refund preorders in the order received.

10) User Content (Reviews, Photos)

If you submit reviews, photos, or other content, you grant JaMiKo a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display that content in connection with the Services and marketing. You represent you own or control the rights to the content and it does not violate any laws or third-party rights.

11) Prohibited Uses

You may not use the Services to: (a) violate laws or infringe IP rights; (b) upload malware; (c) engage in fraud, scraping, or data harvesting; (d) interfere with security or normal operation; (e) resell or export products in violation of applicable laws or manufacturer policies.

12) Intellectual Property

All Site content—including logos, graphics, text, product photography, and software—is owned by or licensed to JaMiKo and protected by IP laws. You may not copy, redistribute, or create derivative works without our written permission.

13) Third-Party Services & Links

We may link to third-party sites or use third-party tools (e.g., payment processors, analytics). We are not responsible for their content, policies, or practices. Your use of third-party services is governed by their terms.

14) Privacy; Marketing Communications

Use of the Services is subject to our Privacy Policy. If you opt into email/SMS marketing, you consent to receive messages from us; you can opt out at any time via the provided methods (reply STOP for SMS, or unsubscribe links).

15) Errors, Inaccuracies & Corrections

Occasionally the Site may contain errors (pricing, availability, typos). We reserve the right to correct errors, change information, or cancel orders if any information is inaccurate, at any time (including after you submit your order), with a refund where applicable.

16) Warranties & Disclaimers

Except as expressly stated, the Services and all products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.

17) Limitation of Liability

To the fullest extent permitted by law, JaMiKo LLC’s total liability for any claim arising out of or relating to the Services or products shall not exceed the amount you paid to JaMiKo for the product(s) at issue. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption.

18) Indemnification

You agree to indemnify, defend, and hold harmless JaMiKo LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your content, or your breach of these Terms or applicable laws.

19) Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules.

Binding Arbitration & Class-Action Waiver

Except for small-claims court or injunctive relief for IP misuse, any dispute will be resolved by binding arbitration administered by JAMS (or another mutually agreed provider) in Harris County, Texas, on an individual basis. You and JaMiKo waive any right to a jury trial or to participate in a class action. The Federal Arbitration Act governs interpretation and enforcement of this section.

20) Termination

We may suspend or terminate access to the Services at any time for any reason, including suspected violations of these Terms. You may stop using the Services at any time.

21) Changes to the Terms

We may update these Terms from time to time. Changes take effect when posted on the Site with the “Last updated” date. Continued use after changes constitutes acceptance.
